BY ACTIVATING A DRIVER ACCESS SUBSCRIPTION, YOU AGREE TO BE BOUND BY THIS AGREEMENT.
The driver database contains personal information of CDL-licensed drivers. Subscriber agrees to use driver data exclusively for: (a) identifying and contacting qualified CDL drivers for employment; (b) evaluating driver qualifications for positions offered by Subscriber; (c) following up on employment applications initiated through the Platform.
Subscriber acknowledges that driver personal information is protected under the Driver's Privacy Protection Act (DPPA). Subscriber represents it is accessing driver data for a DPPA-permitted purpose (employment by a motor carrier) and shall indemnify TezTruck LLC from any claims arising from Subscriber's violation of the DPPA.
If Subscriber uses Platform information for employment decisions, Subscriber must comply with all FCRA provisions including required disclosures, written authorizations from drivers, and pre-adverse and adverse action notices. TezTruck LLC is not a CRA under the FCRA.
Upon cancellation, Subscriber's database access terminates. Subscriber must delete all driver contact information obtained through the Platform within 30 days of termination, except for information related to drivers who have been hired.
Any violation constitutes grounds for immediate termination without refund. TezTruck LLC reserves the right to seek injunctive relief and damages for material breaches. Subscriber agrees to indemnify TezTruck LLC from any claims arising from Subscriber's breach.
This Agreement is governed by the laws of Wyoming. Disputes shall be resolved through binding arbitration as provided in the Platform's Terms of Service.
